NITIN CHHABRA Vs. STATE OF PUNJAB

JUDGEMENT

(1.) THIS petition has been filed under Section 438 of the Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.173 dated 18.9.2013 under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station, Shambhu, District Patiala.

(2.) PRAYER for anticipatory bail has been made by the petitioner in the stated FIR claiming that he has been falsely implicated in this case whereas he has nothing to do with the recovery of medicines from co-accused Anil Kumar (non-petitioner).

(3.) IT is averred that Anil Kumar (non-petitioner) was picked up from his house at Panipat on 17.9.2013 by the Punjab Police and this FIR has been lodged wrongly. It is claimed that mother of the petitioner had then made a representation to the Director General of Police, Chandigarh, regarding which enquiry is pending.
