(1.) BY way of this petition under Section 482 of the Criminal Procedure Code, 1973 (for brevity, the Code), petitioners, the accused, in First Information Report (for short, FIR) No. 58 dated 16.06.2012 under Sections 498A/406 of the Indian Penal Code, 1860 (for short, "the IPC"), recorded at Police Station Gharinda, District Amritsar, seek quashing of above FIR being counter blast to complaint (Annexure P3) filed by the petitioner No. 2, against the complainant -respondent No. 2. In the FIR, Amandeep Kaur, respondent No. 2, had levelled the allegations, against her in -laws' family (petitioners herein), of demand of dowry, harassment and misappropriation of her Istridhan. During the course of trial, the present case was referred by the Court of Chief Judicial Magistrate, Amritsar, to the Mediation and Conciliation Centre, Amritsar for amicable settlement between the parties. Both the parties appeared before the Mediation and Conciliation Centre, Amritsar, on 14.8.2013, and made statements that they have decided to resolve their dispute. In this regard, an affidavit by Amandeep Kaur, complainant -respondent No. 2, has also been filed before this Court during hearing of this case, which is taken on record, saying that the matter has been settled amicably between the parties.
(2.) ON the basis of the aforesaid settlement/affidavit, petitioners, now, seek quashing of the abovesaid FIR saying that the matter has been amicably settled between them and the complainant.
(3.) THE Complainant through her counsel, and the learned State counsel have no objection if the FIR and proceedings arising therefrom, are quashed.
