RAKESH KUMAR Vs. STATE OF PUNJAB

JUDGEMENT

(1.) THIS petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.63 dated 29.7.2012 under Sections 406 and 498 -A IPC registered at Police Station, Lambra, District Jalandhar wherein the offence under Section 313 IPC, was added subsequently.

(2.) THE petitioner (husband), Kuldeep Chand Randhawa (father -inlaw) and Smt. Bimla Rani (mother -in -law) are the accused. Though parents of the petitioner are on bail, the petitioner who was also continuing on bail earlier, but after introduction of the offence under Section 313 IPC and his surrender as a sequel thereto on 8.8.2013, is in custody.

(3.) THIS bail application has been opposed by the respondents claiming that the petitioner is the main accused and the offence, interalia, under Section 313 IPC is serious one.
