JUDGEMENT

(1.) ACCUSED Baldev Singh was convicted under Section 7 read with Section 13(2) of the Prevention of Corruption Act, 1988 and was sentenced to undergo 1 year R.I. and to pay a fine of Rs. 2000/ - and in default to undergo a further period of 1 month.

(2.) THE case of the prosecution is that PW2 Hardeep Kaur was to get a copy of Musavi from the Halqa Patwari of her village. She met accused Baldev Singh who was a Halqa Patwari and requested him to furnish her a copy of Musavi of her land. The accused demanded a sum of Rs. 10,000/ - from her for furnishing a copy of Musavi. Bargain was settled at Rs. 2000/ -. She disclosed the demand made by accused Baldev Singh to PW3 Banta Singh who advised her not to give bribe, but to report the matter to the Vigilance Department.

(3.) PW 2 accompanied by PW3 proceeded to the office of PW7 Vinod Kumar, DSP, Vigilance and produced a sum of Rs. 2000/ - in the shape of currency notes. Phenolphthalein powder test was demonstrated on the said currency notes at the instance of PW7. PW1 Vijay Kumar, an official witness was also associated by the police party headed by PW7.
