JUDGEMENT

(1.) THIS is an appeal directed by the accused -appellants against the judgment and order dated 21.8.2003 passed by Sh. Sunil Kumar Arora, Additional Sessions Judge (Adhoc), Fast Track Court, Ludhiana, vide which the accused -appellants have been convicted under Sections 148, 307, 324, 323, 149 IPC and sentenced to undergo imprisonment and fine as under: - <FRM>JUDGEMENT_450_LAWS(P&H)3_20141.htm</FRM>

(2.) ALL the sentences were ordered to run concurrently.

(3.) THE facts, as enumerated from the record of the case are that on 15.6.2000, at about 9 P.M. injured Ajit Singh was standing near the shop of Pappu Karyana Store situated in the area of Chhauni Mohalla, Ludhiana, for collecting the price of wheat sold by him to the owner of Pappu Karyana Store. In the meantime, accused Babu armed with bottle of soda, Soni armed with sword, Vicky armed with baseball bat, Dara and Kuki armed with daggers came there. Accused Babu raised lalkara that complainant should be taught a lesson for helping one Satish Kumar, whereupon accused Vicky gave a blow with his baseball bat on the forehead of Ajit Singh. Accused Babu caused injury on the back of Ajit Singh with bottle of soda. Kuki gave a blow on the lower part of back of Ajit Singh with his un -sheathed dagger. Accused Soni gave a blow from reverse side of sword on the wrist of Ajit Singh. Accused Dara gave a blow on the right wrist of Ajit Singh with his un -sheathed dagger. Ajit Singh injured then raised alarm, which attracted Paramjit Singh and Kuldip Singh, who also witnessed the entire occurrence. The accused then made good their escape from the spot alongwith their respective weapons. The injured was removed to Civil Hospital, Ludhiana, from where he was referred to CMC Hospital, Ludhiana. The motive for the occurrence as per prosecution version was that accused who belong to Balkmiki community, had suspicion that injured was extending help to one Satish Kumar in a dispute, which earlier took place between him and Balmiki community.
