CHANCHAL SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) THE instant revision has been filed to challenge the order dated 04.04.2014 passed by Additional Sessions Judge, Gurdaspur, declining the application under Section 319 Cr.P.C. to summon and arraign respondent No. 2 to face trial alongwith accused already facing trial.

(2.) FIRST Information Report (FIR) was recorded by Chanchal Singh father of Harjinder Kaur (deceased). It was stated that Gurcharan Singh husband of the deceased was having illicit relation with respondent No. 2, and they both committed her murder. On completion of investigation challan was presented against Gurcharan Singh, husband of the deceased whereas respondent No. 2 was kept in column No. 2 of the challan.

(3.) AFTER the charge was framed against Gurcharan Singh, prosecution examined the complainant as PW -1. Thereafter, an application was filed for summoning of the additional accused/respondent No. 2 which was dismissed on 11.05.2012. The petitioner -complainant filed CRR No. 2345 of 2012, challenging the order of the trial Court. That petition was dismissed as withdrawn on 21.10.2013 with liberty to move another petition before the trial Court after examination of some other witnesses.
