SITARA SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) THIS order shall dispose of Criminal Misc. No. 11995 of 2014, filed by applicant -appellant Sitara Singh and Criminal Misc. No. 11884 of 2014, filed by applicant -appellant Pati Raj for suspension of sentence during the pendency of appeal.

(2.) LEARNED Judge, Special Court, Amritsar, vide judgment of conviction and order of sentence dated 09.01.2013, passed in case FIR No. 346 dated 29.08.2009, held the applicants -appellants Sitara Singh and Pati Raj guilty for the commission of offence punishable under Section 20 of the Narcotic Drugs & Psychotropic Substances Act, 1985 and sentenced them to undergo rigorous imprisonment for a period of 10 years and to pay a fine of Rs. 1,00,000/ - each under the aforesaid Section.

(3.) AS per custody certificates, produced by learned State counsel, the applicant -appellant Sitara Singh has already undergone 4 years 8 months and 26 days and applicant -appellant Pati Raj has already undergone 4 years 8 months and 24 days of actual sentence.
