Ravinder Kumar - appellant was held guilty for the murder of his wife and he has filed this appeal against the judgment and order dated 29.07.2003 passed by learned Sessions Judge, Amritsar vide which he was convicted and sentenced to undergo imprisonment for life and to pay a fine of Rs.1000/- for committing an offence punishable under section 302 IPC. It was also ordered by learned trial Court that in default of payment of fine, the appellant would undergo further rigorous imprisonment for a period of six months.
(2.) The prosecution case set up in the report under section 173 Cr.P.C. is that the FIR was recorded on the statement of Constable Baldev Singh on 15.06.2000. On that day, he alongwith Constable Surjit Singh had visited village Galowali Kullian in connection with some secret official duty. When they were passing through the street in front of the house of Rampal at about 1.00 PM, they heard shrieks coming from the house. The main door of the house was found closed but it was not bolted. After opening the main door, they had entered inside the house and saw that Ravinder Kumar alias Laddu son of Rampal was strangulating the neck of a woman by putting one end of sari, which she was wearing around her neck, in the first room adjoining the street. Ravinder Kumar appellant was known to them earlier to this occurrence. On seeing them, the appellant had fled away from the spot after leaving his wife.
(3.) They found the woman lying dead on the ground due to strangulation. Later, they learnt the name of that woman as Parbati, wife of the appellant. Constable Baldev Singh left Constable Surjit Singh on the spot to guard the dead body and he went to the police station for giving information. On the way, he met Inspector Gian Singh alongwith other police officials, present on patrolling duty at the turning of village Galowali. Inspector Gian Singh recorded the statement of Baldev Singh, Ex, PD, which was duly signed by him after admitting the same to be correct. The endorsement was made by Inspector Gian Singh on the statement and ruqa was sent to the police station for registration of the case through Constable Gian Singh, upon which the FIR Ex.PD was recorded by SI Jagir Singh.
