JUDGEMENT

(1.) PETITIONER has approached this Court with a grievance that despite he having been issued the appointment letter dated 16.01.2014 (Annexure P -5) on the post of Post Graduate Teacher (Mathematics), the District Education Officer, Palwal -respondent No. 3, is not issuing the posting orders.

(2.) PETITIONER , in pursuance of the appointment letter issued to him, submitted his joining report to the District Education Officer, Palwal. Despite the joining report having been accepted, he is not being issued the posting order and rather, the District Education Officer, Palwal -respondent No. 3 has sought guidance with regard to joining of the newly appointed Post Graduate Teachers from the Director Secondary Education, Haryana, vide communication dated 31.01.2014, stating therein that the experience certificate, which has been submitted by the petitioner is not entered in the record register of the office. Counsel for the petitioner contends that the verification of the experience certificate of the petitioner has been done by the office of Director, Secondary Education, Haryana and in support thereof he refers to the letters dated 02.08.2013 (Annexure P -3) and 19.11.2013 (Annexure P -4). On this basis, counsel contends that there is no justification on the part of the District Education Officer, Palwal, to deny the petitioner the posting orders or not to permit him to join the duties. Despite reference/guidance sought through letter dated 31.01.2014 (Annexure P -7) issued by the office of District Education Officer, Palwal, the Director, Secondary Education, Haryana, till date has not taken any decision thereon.

COUNSEL for the petitioner contends that the petitioner, at this stage, would be satisfied if a direction is issued to the Director, Secondary Education, Haryana, Panchkula -respondent No. 2 to consider and decide the representation dated 06.02.2014 (Annexure P -8) filed by the petitioner, and pass an appropriate order on the basis of letter dated 31.01.2014 (Annexure P -7) within some specified time.
