JUDGEMENT

(1.) THIS appeal is by the claimant, who is seeking enhancement of the compensation awarded to him by the Motor Accident Claims Tribunal, Sirsa who vide its award dated 16.10.2007 allowed a sum of Rs.40,000/ - for the injuries suffered by him.

(2.) FOR the sake of brevity the relevant facts may be referred. On 04.06.2004, Subhash Chander and Rajpal left for village Darba on a motorcycle driven by Rajpal. The claimant was sitting on the pillion. At about 1.00 pm when they had reached near the canal of village Tajia Khera respondent No.1 came on the offending vehicle bearing registration No.PB -10A -8080 and struck against the motorcycle. The claimant and his co -rider fell down. The claimant suffered a fracture.
