JUDGEMENT

(1.) ON 13.10.2014, the following order was passed by this Court: -

(2.) THE CCTV footage procured by the prosecution from Max Hospital has been played in the Court with the assistance of the Investigating Officer. From the CCTV footage, it appears that the petitioner did not accompany the alleged proclaimed offender, Sumedh Gulati, to said Max Hospital in a private vehicle nor the co -accused Ajay Chaudhary is seen in the footage.

KUMAR SUMIT 2014.11.03 14:12 I attest to the accuracy and authenticity of this document The learned counsel for the petitioner refers to DDR, wherein two persons were stated to have accompanied the petitioner, whereas, the FIR mentioned three persons. The learned counsel further refers to photographs taken from Toll Plaza Karnal and Panipat respectively, showing Ajay Chaudhary to be present on the above toll plaza's at the relevant time. The occurrence took place on 26.08.2014, whereas, the FIR was registered on 30.08.2014, after a delay of four days.
