(1.) THE prosecutrix has filed this appeal against the judgment dated 10.04.2013 passed by learned Addl. Sessions Judge, Fast Track Court, Rupnagar, vide which accused Inderjit Singh was acquitted of the charges framed against him.
(2.) BRIEFLY stated, Inderjit Singh, friend of the father of the prosecutrix used to visit her house. Mohan Lal, father of the prosecutrix had died during her childhood. One year before the occurrence, Inderjit Singh told the mother of the prosecutrix that she should not worry about the marriage of her daughters as he being the friend of her husband is also responsible for the marriage of her daughters. After some days, Inderjit Singh put forward the marriage proposal of the prosecutrix with his brother Tarlok Singh. He also told that his son is residing in America and he would get his second daughter's marriage solemnised with his son. Inderjit Singh also gave the mobile number of the prosecutrix to his brother Tarlok singh, residing in America and introduced his brother with the prosecutrix. Thereafter, Tarlok Singh informed the prosecutrix that he is coming to India on 28.01.2012 and asked the prosecutrix to accompany Inderjit Singh to Amritsar to receive him from the airport. Thereafter, the prosecutrix accompanied Inderjit Singh to Amritsar airport. On return journey, she asked both of them to drop her at her house in the area of Chamkaur Sahib. However, both of them took her to their village Pippal Majra. There Tarlok Singh by alluring the prosecutrix to marry with her, had been raping her and in the absence of Tarlok Singh, Inderjit Singh had also been raping her. When she resisted, she was threatened and confined in the room and not allowed to talk to her mother. One day, the prosecutrix raised hue and cry, on which both the accused took her on 29.02.2012 by a vehicle and dropped her near Gurdwara Ranjitgarh near the house of the prosecutrix. Thereafter, she did not inform the occurrence to the police to keep the honour of her family. Later on, she made the statement before ASI Harbans Singh, on which FIR dated 03.04.2012 was registered under Sections 342, 376, 506 read with Section 34 IPC. Accused Tarlok Singh became proclaimed offender and challan was filed only against Inderjit Singh. Accused Inderjit Singh was charge sheeted under Sections 342, 376, 506 read with Section 34 IPC. To support its case, the prosecution examined eight witnesses including prosecutrix.
(3.) ON the conclusion of the trial, learned Addl. Sessions Judge, Rupnagar, acquitted accused Inderjit Singh, giving him the benefit of doubt. The learned Addl. Sessions Judge also ordered the initiation of the proceedings under Section 344 Cr.P.C. against the prosecutrix. The prosecutrix has come up in appeal against the said judgment. We have heard learned counsel for the appellant and have also gone through the case file.
