(1.) BALJEET (complainant) has filed this appeal under Section 372 Cr.P.C against the judgment and order dated 30.09.2013/04.10.2013, passed by the court of Additional Sessions Judge, Bhiwani, vide which accused Balwan and Kalawati (respondents No.2 and 3 herein), father -in -law and mother -in -law of deceased Sushila were acquitted of the charges framed against them, while Mehar Singh, husband of the deceased, was convicted under Sections 304 -B, 498 -A and 328 IPC. Mehar Singh has filed separate appeal against his conviction.
(2.) THE brief facts of the case are that on 12.8.2012, a medical rukka was received from C.H.C Loharu in Police Station Loharu that Sushila wife of Mehar Singh was brought dead in the Hospital. Police went to the Hospital, where Baljeet, brother of deceased Sushila, submitted an application to the Police, on the basis of which the FIR was registered. In the said application, the complainant stated that marriage of his sister Sushila was solemnised with Mehar Singh six years ago. The in -laws of his sister used to beat her repeatedly. They used to lock her in a room and did not provide food etc. They were raising repeated demands of dowry articles. A number of times, cash was handed over to them, but demands of her inlaws went on increasing. Many times, Pachayats were convened and they tried to make the accused understand but the accused did not mend their ways. On 11.8.2012, in the late evening, the complainant came to know from some unknown person that Sushila has died because of administration of some poisonous substance. He was sure that his sister Sushila was murdered by her husband Mehar Singh, father -in -law Balwan, mother -inlaw Kalawati, brother -in -law (Devar) Raju, elder brother of father -in -law Hawa Singh, Santosh (Santro) wife of Hawa Singh and Om Parkash son of Hawa Singh.
(3.) DURING investigation, Hawa Singh, Om Parkash, Rajbir alias Raju and Santro were found innocent. However, the remaining three accused were challaned. They were charge sheeted under Sections 498 -A, 304 -B and 328/34 IPC, and alternate charge under Section 302/34 IPC was framed.
