(1.) This order shall dispose of C.O.C.P. Nos. 109, 348, 349, 111, 113, 114, 115, 116, 117, 118, 119, 120 and 121, all of 2004, as the same have arisen from a common judgment.
(2.) Petitioner is a Class IV employee of the Punjab Government. Being matriculate he was denied promotion in Class III, although his juniors were promoted. He filed a writ petition which was allowed by this Court on 6.1.2003, wherein it was found that the petitioner was entitled for promotion from Class IV to Class III from the date, the persons junior to him had been promoted. It was further ordered that it the petitioner was found eligible to be promoted, his promotion shall be released within a period of 3 months from the date of the order and that the petitioner shall also be entitled to all consequential benefits.
(3.) Earlier the petitioner filed a Contempt Petition before this Court which came up for hearing on December 1, 2003. The rule was discharged in view of undertaking of the respondents that the petitioner shall be allowed to join on the promoted post within one month from thereof and that decision regarding consequential benefits shall also be taken within the aforesaid period. The petitioner has invoked the jurisdiction of the Contempt Court again, pointing out that the consequential benefits have not been paid to the petitioner. In pursuance of the notice issued, a reply has been filed. Along with the reply an order dated 7.1.2004 had been appended, wherein the arrears of ante-dated notional promotion has been denied to the petitioner by relying upon the judgment of the Hon'ble Supreme Court in State of Haryana v. O.P. Gupta, 1996 2 SCT 294
