JUDGEMENT

(1.) THIS appeal is directed against the order dated January 13, 1992 whereby a petition under Section 13 of the Hindu Marriage Act filed by the appellant -husband has been dismissed.

(2.) THE case as set up by the appellant in the petition is as under :

(3.) FROM the pleadings in the divorce petition, it is apparent that the petition is one falling under the second limb of Clause (iii) of Sub -section (1) of Section 13 of the Hindu Marriage Act. Before going ahead, it will be appropriate to notice the provisions aforesaid, which read as under :
