(1.) This order of mine would dispose of Civil Revision No. 1799 of 1993 and Civil Revision No. 3906 of 1992.
(2.) According to the petitioners, Ram Lal-defendant (respondent herein) agreed to sell land measuring 20 kanals 14 marlas at the rate of Rs. 40,000/- per acre. A sum of Rs. 20,000/- is alleged to have been paid to Ram Lal at the time of execution of the agreement. The petitioners filed a suit for specific performance against Ram Lal. On appearance, Ram Lal denied having executed an agreement to sell. He also denied having ever handed over the possession of the land to the petitioners. The trial Court only on the basis of agreement to sell, restrained Ram Lal from interfering in possession of the petitioners. This order was challenged by Ram Lal in appeal, which was allowed and the order of the trial Court was set aside. This order is being challenged in the present Revision petition.
(3.) In Civil Revision No. 3906 of 1992, the co-sharers had filed a suit against the petitioner and his brother, Gaje Singh, on the ground that the petitioner and his brother have no right to interfere in their possession. The trial court did not grant them injunction, but in appeal, the petitioner and his brother were restrained from interfering in their possession. That order is being challenged in this revision petition.
