JUDGEMENT

(1.) The petitioner's case is that he has been in cultivating possession of Nazool land measuring about 38 kanals and 8 marlas bearing Khasra Nos. 7/21, 22/2, 8/12,1, 12/21, 8/22, 24 and 25 situated in village Hussainpura, for the last about eleven years (this petition was filed in February, 1980). The Government had decided to give preference for allotment of Nazool land to Harijan cultivators who were in possession of such land and also to ex soldiers. The petitioner fulfilled all the requisite conditions for allotment of Nazool land, he being a Harijan and ex-soldier of the Indian Army and also being in possession of Nazool land, as stated in the petition. He had also installed a tubewell in the land and raised some structure thereon.

(2.) On June 3, 1968, Shri N.S. Cheema, Assistant Collector, Patiala, recommended to the Collector, District Patiala, that agricultural Nazool land situated in village Hussainpura, District Patiala, be allotted to the following persons :-
