(1.) This is unsuccessful plaintiffs regular second appeal.

The plaintiff filed suit for decleration that the order dated 27.8.1984 by which his three annual increments were stopped were illegal, arbitrary and based upon no evidence and also against the mandatory provisions of Punjab Civil Services (Punishment and Appeal) Rules, 1970 (for short "the Rules").
(3.) Briefly put, the plaintiff was working as a conductor in the Punjab Roadways and was charge-sheeted on the basis of complaint of the checking staff. Charges of embezzlement were levelled against him and since the reply filed by him was found to be without any substance, the enquiry officer was appointed by the General Manager who passed the impugned order dated 27.8.1984. It is the case of the plaintiff that the impugned order is wholly vitiated as the inquiry officer did not give him the assistance of a co-worker which was also otherwise against the mandatory provisions of the Rules.
