JUDGEMENT

(1.) Vide his judgment and order dated August 2, 1983, the learned Additional Sessions Judge, Barnala, convicted the appellants under Sections 302/34, Indian Penal Code and, sentenced each one of them to undergo rigorous imprisonment for life and to pay a fine of Rs. 2,000/-, and in default of payment of fine, to undergo further rigorous imprisonment for six months.

(2.) The case of the prosecution in brief is that Bhola Singh deceased was working as a Sin with Nazir Singh appellant. Nazir Singh appellant is married to the sister of Sajjan Singh appellant. It is said that Bhola Singh deceased developed intimacy with the wife of Nazir Singh appellant and when he was snubbed on that account, he stopped working for him. However, about two or three months prior to the present occurrence, he was persuaded to rejoin his work and he again started working for Nazir Singh appellant.

(3.) Bhola Singh deceased appears to have been murdered on the night intervening October 4/5, 1982. His dead body was found on the road adjoining the field of Nazir Singh appellant. The police moved into action on the basis of F.I.R. Exhibit PG lodged by Piara Singh P.W. 3 at 5 a.m. on October 5, 1982 at Police Station Sehna.
