JUDGEMENT

(1.) GURDIAL Singh petitioner was convicted wider Section 9 of the Opium Act and sentenced to one years' rigorous imprisonment and a fine of Rs. 400/ - by the Judicial Magistrate Ist Class, Zira. On appeal, the learned Additional Sessions Judge, Ferozepur, in an exhaustive and lucid judgment and adverted to several contentions raised on behalf of the petitioner and repelling the same, has maintained his conviction and sentence. He has now come up by way of revision.

(2.) THE learned counsel for the petitioner has not been able to singularly challenge the petitioner's the conviction on merits. The only prayer made has been for reduction in the sentence. It is pointed out that the occurrence took place as far -back as 1980. There is, however, some scope for reduction in the sentence in the present case, keeping in view that the conviction is not challenged and the case is now an old one I accordingly reduce his sentence of imprisonment to 6 months but enhance the amount of fine to Rs. 800/ - as I feel that it was meet the ends of justice. In case of default of payment of fine, he shall suffer rigorous imprisonment for 6 months.

(3.) WITH the aforesaid modification in the sentence, the revision petition is dismissed. Petition dismissed.
