JUDGEMENT

(1.) CRIMINAL Appeals Nos. 377 -DB, 439 -DB, 312 -DB, 444 -DB, 313 -DB, 440 -DB, 441 -DB, 442 -DB, 44S -DB, and 446DB of 1983 as also Criminal Revision No. 903 of 1983 are being disposed of by this judgment as they all arise out of the same incident.

(2.) ORIGINA 1Jy 8 persons were sent up for trial. The learned Additional Sessions Judge, Ludhiana, vide his judgment and order dated 30.3.1983 gave the benefit of doubt to Nachhatar Singh, Jagan Singh and Jabar Singh accused persons. The five appellants were convicted and sentenced as under: Dalip Singh appellant U/s 148, I.P.C R.I. for two years. U/s 302/149 I.P.C Life imprisonment and a fine of Rs. 1000/ -. In default of payment of fine, R.I. for 6 months. U/s 404, I.P.C. R.I. for 3 years and a fine of Rs. 300/ -. In default of payment of fine, R.I. for one month. U/s 307/149, I.P.C. R.I. for 2 years and a fine of Rs. 200/ -. In default of payment of fine, R.I. for one month. U/s 27, Arms Act. R.I. for six years. Mann Singh appellant U/s 148, I.P.C. R.T. for two years U/s 302/149, I.P.C. Life Imprisonment and a fine of Rs. 1000/ -. In default of payment of fine, R.L for six months. U/s 307/149, I.P.C. R.I. for 3 years and a fine of Rs. 300/ -. In default of payment of fine, R.I. for one month. U/s 27, Arms R.I. for six months. Act Jagdeep Singh appellant U/s 148, I.P.C. R.I. for two years. U/s 302/149, I.P.C. Life imprisonment and a fine of Rs. 1000/ -. In default of payment of fine R.I. for six months. U/s 307/149, I.P.C. R.I. for three years and a fine of Rs. 300/ -. In default of payment of fine, R.I. for one month. U/s 27, Arms Act R.I. for six month. Gurdial Singh appellant U/s 148, I.P.C. R.I. for two years. U/s 302/149, I.P.C. Life imprisonment and a fine of Rs. 1000/ -. In default of payment of fine, R.I. for six months. U/s 307/149, I.P.C. RI. for 3 years and a fine of Rs. 300/ -. In default of payment of fine, R.I. for one month. U/s 27, Arms Act R.I. for six months. Davinder Singh appellant U/s 148 I.P.C. R.I. for 2 years U/s 302/149, I.P.C. (3.) DALIP Singh appellant died after this conviction. His mother bas filed an application for permission to prosecute the appeal qua him.
