JUDGEMENT

(1.) Vide his judgment and order dated 12th August, 1983, the learned Additional Sessions Judge, Barnala, convicted the appellant under sections 302, Indian Penal Code, and sentenced him to undergo imprisonment for life and to pay a fine of Rs. 2,000/-, or in default of payment of fine, to undergo further rigorous imprisonment for six months.

(2.) Jarnail Singh appellant is stated to have caused fatal blows with a dang to Harnek Singh deceased at 8.30 p.m. on October 30, 1982, in village Sukhpura Maur. Report Exhibit PE about this incident was lodged by Gurnam Singh P.W. 2, brother of the deceased, at 10.50 p.m. at Police Station Shehna. The statement of Dr. Vijay Kumar P.W. 1 shows that the deceased had been given eight blows, some of which were on the throttle region also. According to the said doctor, the injuries were ante-mortem in nature and were sufficient to cause death in the ordinary course of nature.

(3.) The prosecution claims that the deceased was working as a sin at village Sukhpura Maur with one Gurcharan Singh son of, Amar Singh Jat of that place. The appellant's wife probably wanted to take some cobs of maize from the field cultivated by the deceased, upon which the latter took exception. The lady probably went and complained to the appellant who caused the injuries to the deceased, for the so-called insult meted out by the deceased to his wife.
