This revision-petition by the State is directed against an order, dated 6th March, 1973, of the learned Senior Subordinate Judge, Sangrur, by which he dismissed an application made by the defendant-State, raising objections against the report of the Local Commissioner and praying that the latter should be asked to make a fresh report taking into consideration the objections raised.
(2.) Mr. Sarup Singh, appearing for the Advocate-General, Punjab, contends that the learned trial Judge had arbitrarily rejected the application of the petitioner by an ex parte order passed at his back.
(3.) The argument is attractive, but on going through the history of the case and the numerous opportunities granted to the petitioner to file objections against the report of the Local Commissioner, I find that it cannot be accepted.
