KHUSHI Vs. STATE OF PUNJAB

JUDGEMENT

(1.) The present petition has been filed by the petitioners wherein age of petitioner No.1-Khushi daughter of Kuldeep Singh has been stated to be 19 years by making a reference to the Aadhar Card wherein the Date of Birth has been recorded as 13/2/2004.

(2.) Learned State counsel has handed over today a copy of the Matriculation Certificate issued by the Punjab School Education Board wherein the Date of Birth of the petitioner No.1-Khushi has been recorded as 24/9/2007. Hence, she is 16 years of age as per the Matriculation Certificate. He further informs that a criminal case has already been registered against the petitioner No.2 for having taken away the minor girl.

(3.) Apparently, disputed questions of fact are involved in the present case and there is no occassion for directing issuance of any protection to the petitioner No.2 at this stage. However, the petitioner No.1 shall be produced before the Senior Superintendent of Police, Sangrur as well as to the Child Welfare Committee of the District concerned.
