JUDGEMENT

(1.) Appellant has preferred this appeal challenging his conviction and sentence for commission of offence punishable under Sections 419/ 467/ 468/ 471 of the Indian Penal Code, 1860 (IPC for short) and Section 13 (2) of the Prevention of Corruption Act, 1988 (for short 'the Act') read with Section 120-B IPC as ordered by the trial Court vide judgment/ order dated 26.4.2004 in FIR No.54 dated 5.8.1997 registered at Police Station State Vigilance Bureau, Patiala.

(2.) Prosecution story, in brief, is that Roop Singh was the sarpanch of the village and he obtained loan with the help of appellant by impersonation. Appellant thumb marked the loan papers as Darshan Singh son of Maghi Ram. The loan was advanced by the bank to the tune of Rs. 10,000/- for purchase of cow.

(3.) As the loan was not repaid by the loanee, it transpired that Darshan Singh had, in fact, never approached the bank for advancement of loan. Rather the loan had been taken by Roop Singh, sarpanch with the help of the appellant by impersonation.
