State Of Haryana And Another Respondents

JUDGEMENT

(1.) THE petitioner is Sarpanch of Gram Panchayat Diwana, Block Jakhal, District Fatehabad, who has been suspended on account of some charges against him. The petitioner has challenged the said order of suspension. Counsel for the petitioner has argued that the petitioner was suspended on 13.07.2012 and still the order of suspension is continuing. He has argued that order of suspension cannot survive after a period of one year but it has been admitted that period of one year would start from the date of handing over the charge which is still with the petitioner. It is also argued that the petitioner is not guilty of any embezzlement but it has been found by the Appellate Authority that in the regular inquiry, the petitioner has been held guilty of committing irregularities while executing the development work in the village and caused loss to the Gram Panchayat by making payment of the electricity bills in respect of the leased land. It was also admitted by the petitioner that she had not obtained the quotations for the development work of land levelling costing more than Rs. 15 lacs, which should have been done by taking estimates, measurement of levels, calling of quotations from all the eligible contractors and further after holding proper negotiations, tender should have been given

(2.) KEEPING in view the aforesaid facts and circumstances of the case, I do not find any merit in the present petition and hence, the same is hereby dismissed.
