HAIDER Vs. STATE OF PUNJAB

JUDGEMENT

(1.) Petitioner has filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No. 42 dated 20.2.2012 under Section 307, 324, 148, 149 of the Indian Penal Code and Section 25, 27 of the Arms Act, 1959, registered at Police Station City Tarn Taran, District Tarn Taran.

(2.) Prosecution story, in brief, is that on 13.2.2012, at about 12.30 P.M., complainant Rohit Kumar along with Samma Singh, had gone to Tarn Taran for some personal work. When they reached near the gate of the house of his aunt Kuldeep Kaur, two vehicles came from Nardi Adda, Tarn Taran side.

(3.) Sunil Sabharwal, Karan Kumar, Sikandar Singh, Prince, Manna, Ashwani Kumar, Sajan Kumar, Sabhu and Honey, were armed with datars whereas Ravi was armed with a kirpan.
