KULVIR KAUR Vs. STATE OF PUNJAB & OTHERS

Decided On October 08, 2013
Kulvir Kaur Appellant
V/S
STATE OF PUNJAB AND OTHERS Respondents

JUDGEMENT

(1.) THE widow of late Sh. Amarjit Singh has approached this Court impugning the action of the respondent -authorities in not counting the service rendered by her late husband i.e. from 10.12.1983 to 25.04.1997 in a private aided school and against an aided post towards qualifying service for grant of pensionary/retrial benefits. Counsel would submit that having served in the private aided school for the period in question, her late husband had joined the Punjab State Education Department as PTI on 26.04.1997 and had died in harness on 15.09.2000. Counsel further argues that the claim as raised in the instant writ petition would be covered in the light of judgment dated 10.03.2010 rendered by this Court in CWP No. 14238 of 1991 titled as Sukhdev Singh & others Vs. State of Punjab & others. In the light of the facts noticed herein above, the present writ petition is disposed of with a direction to the respondent -authorities to consider the claim of the petitioner and to take a final decision on the legal notice dated 19.08.2013 (Annexure P -1) strictly in accordance with law and by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order.
