IT has been pleaded that the Subordinate Service Selection Board, State of Punjab issued advertisement dated 04.11.2012 (Annexure P -1), wherein apart from other posts, applications were invited for recruitment of 72 posts of School Librarians. 36 posts were to be filled up from the general category candidates and 1 post was reserved under the Freedom Fighter Category. The petitioner applied against the general category as also Freedom Fighter category. Counsel submits that in the process of selection and in the merit list prepared for calling of candidates for interview, the name of the petitioner appeared at Sr. No. 49 in the general category and at Sr. No. 1 in the Freedom Fighter category. A public notice was issued for conducting of interviews on 8th and 9th May, 2013 and on both dates, the petitioner duly appeared but he was not permitted to participate in such interview process. It has further been averred that the petitioner has been informed that his qualification of diploma of Library Science is not a recognized qualification as it has been done from CMJ University, Meghalaya. Counsel for the petitioner would argue that CMJ University, Meghalaya is a duly approved and recognized university by the University Grants Commission and towards such submission would advert to a document appended at Annexure P -8. That apart, it has been argued that the petitioner was never given an opportunity as regards showing his eligibility pertaining to the qualification prescribed for the post.

HAVING heard counsel for the petitioner at length, this Court is of the considered view that in the absence of any specific order having been placed on record, the issue as regards the candidature and eligibility of the petitioner for the post of School Librarian cannot be gone into in the present writ petition. Be that as it may, the petitioner is certainly vested with a right to be informed as regards the precise reason/basis on which his candidature has been rejected and his right for consideration for appointment to the post has been declined.
