THE present petition has been filled under Section 482, Cr.P.C. challenging the order dated 05.07.2013 passed by learned Additional Sessions Judge, Ludhiana, whereby the Criminal Revision filed by the petitioner Manpreet Singh (husband) challenging the order dated 21.11.2012 passed by learned Judicial Magistrate Ist Class, Ludhiana, granting maintenance to the respondents, was dismissed.
(2.) BRIEF facts of the case are that the marriage of Jaspinder Kaur (respondent No.1) was solemnized with Manpreet Singh (petitioner) on 27.02.2010, according to sikh rites and ceremonies. Gurmandeep Singh (respondent No.2) was born out of the said wed -lock on 04.12.2010. Sufficient dowry articles were handed over to the petitioner by the family members of respondent No.1 with an understanding that the same shall be handed over to the respondent No.1 for her use. The husband and his family members were not happy with the dowry articles and they started raising illegal demands of more and more dowry in the shape of cash or kind. Respondent No.1 expresses her inability to fulfil the illegal demands of the petitioner and his family members. The petitioner started maltreating the respondent (wife) and ultimately she was turned out from the matrimonial home by the petitioner (husband). Since the respondent (wife) and the minor child had no source of income and as such they were unable to maintain themselves. A petition under Section 125, Cr.P.C., was presented before the learned Judicial Magistrate Ist Class, Ludhiana, seeking Rs.10,000/ - per month as maintenance.
(3.) AFTER hearing the learned counsel for both the parties and taking into consideration the facts and circumstances of the case, the learned Magistrate allowed the petition filed by the respondents and ordered the petitioner to pay Rs.3000/ - per month as interim maintenance.
