(1.) This revision has been filed against the concurrent findings of conviction recorded by the Courts below for offences under Sections 467/468/471 of the Indian Penal Code (IPC). The trial Court also convicted the petitioner for offence under Section 420 IPC but the Appellate Court acquitted him of the said charge maintaining conviction for other offences as aforesaid. The petitioner was sentenced to undergo rigorous imprisonment for a period of three years and to pay a fine of Rs. 3000/- under Section 467 IPC. Similar sentences have been awarded to him under Sections 468 and 471 IPC. It was further directed that the petitioner would undergo Simple Imprisonment of six months in default of payment of fine. The sentences of imprisonment were to run concurrently.
(2.) Name of the petitioner is Mukesh Mangla S/o Vinod Kumar but he prepared forged documents in different names. On secret information received by Sub Inspector Umesh Bala, the petitioner was arrested. From his personal search, a PAN card bearing Income Tax Department No. AKJPG6543M in the name of Mahesh Gupta son of Vivek Kumar Gupta, date of birth 18.8.1980 and other PAN card bearing Income Tax Department No. AMWPG5808J in the name of Lokesh Goyal son of Suresh Goyal, date of birth 5.9.1979 were recovered. Both these PAN cards bear his photographs. Apart from that, credit card of Axis Bank bearing No. 4718610001352369 in the name of Lokesh Goyal, ICICI bank card bearing No. 377041471222009 in the name of Lokesh Goyal, ATM card in the name of Mahesh Gupta of OBC bank No. 4357089006692093; pass book in the name of Mahesh Gupta OBC bank account No. 09212011004361, credit card of HSBC Bank No. 4384599913811328 in the name of Rajiv Kumar Singh and driving licence No. HR-51-5405/2007 valid up to 24.5.2007 in the name of Rajiv Singh son of Bhim Singh resident of 3/184, Link Road Sector 28 Faridabad, bearing the photograph of accused Mukesh Mangla, ATM card of Canra Bank, bearing No. 4214582847005122 in the name of Mukesh Mangla, ATM card No. 4214260571416738649 of IDBI Bank in the name of Mukesh Mangla, 'Pulsar' motorcycle bearing registration No. HR-51-X-4392 along with RC in the name of Mahesh Gupta son of Shri V.K. Gupta resident of 3/184, first floor, Tender Heard School, Sector 28 Faridabad were also recovered. These documents along with the abovestated motor-cycle were taken into possession vide separate recovery memos.
(3.) The plea of the petitioner during his examination under Section 313 Cr.P.C. was of simple denial.
