JUDGEMENT

(1.) THIS appeal is against the award of the MACT case No. 122 of 2008 dated 10.2.2009 passed by Motor Accident Claims Tribunal, Panipat. On 8.7.2013, on behalf of the appellant statement (separately recorded) was made by learned counsel for the appellant to accept Rs. 35,000/ - (Rs. Thirty Five Thousand only) more, over and above, the amount already awarded by the MACT concerned, in full and final settlement of the claim in this appeal. Today, on behalf of the respondent -Insurance Company concurrence has been given to this effect. Accordingly, Rs. 35,000/ - (Rs. Thirty Five Thousand only) is allowed as further compensation over and above the compensation already awarded by the MACT. Two months' time is allowed to the Insurance Company to deposit the amount before the MACT concerned from today, failing which interest at the rate of 9% per annum shall follow on this amount from the date of this order. The enhanced amount would be paid to the appellant and would be disbursed to him in cash by the Motor Accident Claims Tribunal.

(2.) THE appeal is disposed of accordingly, subject to all just exceptions available in favour of the respondent -Insurance Company. Copy of the order be supplied/sent to the counsel/parties and file be returned to the High Court.
