JUDGEMENT

(1.) The petitioner was selected for the post of Sub Inspector in Central Police Organizations (CPOs) through Special Examination, 2010. The petitioner applied for the post under reserve category of Other Backward Class (OBC). The overall merit of the petitioner was 197 whereas the merit of the last candidate selected in the OBC category is 193.75 in BSF, 195.25 in CRPF and 195.75 in SSB.

(2.) The petitioner's case for appointment has been rejected on scrutiny for the reason that the caste certificate issued to the petitioner in the State of Rajasthan may have been on the format prescribed for caste certificates issued by a competent authority in Rajasthan but was not in the format provided under the advertisement for Central Government service.

(3.) There is, however, no dispute that the caste certificate issued by the State of Rajasthan was prior to closing date i.e. 02.11.2010.
