(1.) PRAYER in this petition is for grant of regular bail to petitioner Rajinder Kumar Garg who has been booked for having committed the offences punishable under Sections 420, 465, 467, 468, 471 and 120B, IPC, in a case arising out of FIR No. 229, dated 07.09.2013, registered at Police Station, Mandi Gobindgarh, District Fatehgarh Sahib. Learned counsel contends that even if the case of the prosecution is taken at its face value then also the mischief's of sections for which the petitioner has been booked are not attracted; that all the offences for which the petitioner has been booked are triable by the learned Judicial Magistrate Ist Class; and that the petitioner is behind the bars from 09.09.2013.

LEARNED counsel for the State, on instructions from ASI Kuldeep Singh, Police Station, Mandi Gobindgarh, District Fatehgarh Sahib, very fairly concedes that there are no allegation of cheating and forgery so far as the petitioner is concerned. He further submits that the only allegation against the petitioner is that after registration of the case, he wrongly informed the police with regard to missing of his sons so that the complainant could be implicated in a false case. He, however, submits that the material has emerged on record that the petitioner forged the signatures on the cheques allegedly issued by the complainant.
(3.) LEARNED counsel for the complainant opposed the grant of bail on the premise that the petitioner in connivance with his sons committed the offences, therefore, he does not deserve the concession of bail.
