JUDGEMENT

(1.) PETITIONER has approached this Court with a grievance that he was entitled to promotion to the post of Lecturer in English and also in History. Since the petitioner is more qualified in History and is interested in the said subject, he made a request to the respondents that his claim for promotion to the post of Lecturer in History be considered although on considering the claim of the petitioner for promotion as a Lecturer in English, the same had been accepted. The case of the petitioner has been duly referred to the competent authority for consideration for promotion to the post of Lecturer in History but as per the information available on the website of the department, an objection has been raised with regard to the non-availability of the Annual Confidential Report of the petitioner for the year 2008-09. This, the counsel for the petitioner contends, is not acceptable in the light of the fact that the said very period, for which the claim of the petitioner has not been considered stating non-availability of the Annual Confidential Report, has already been taken into consideration by the respondents while considering the claim of the petitioner for promotion to the post of Lecturer in English and the petitioner has been found eligible resulting in passing of an order promoting him as such.

COUNSEL , at this stage, submits that liberty may be granted to the petitioner to file a detailed representation projecting the whole situation therein to the Secretary, Department of Education, Punjab-respondent No. 1, which shall be filed within a period of four weeks from today and the same may be directed to be considered and decided within some specified time.
