JUDGEMENT

(1.) Through the present petition, the petitioner lays challenge to the judgments passed by the Courts below whereby he has been convicted and sentenced for commission of offence punishable under Sections 420, 465, 467, 471, 472 and 474 of the Indian Penal Code (for short "IPC").

(2.) The petition was admitted on 25.2.2002. The petitioner has already undergone the entire sentence awarded to him for commission of the aforesaid offences.

The allegations against the petitioner are that on receipt of secret information that the accused (petitioner herein), an employee of Water Works, Jatton Mandi, is indulging in forging registration certificates, route permits, insurance policies by affixing forged stamps and signatures of the officers and delivering the same to the people. A case was registered in Police Station, Jatton for the aforesaid offences on 19.6.1994 vide FIR No. 30. A raid was conducted in pursuance of secret information, but the house of the petitioner was found locked. On 30.6.1994, truck bearing Registration PAR-4174 was searched which was displaying fictitious registration No. PUT 3053. The truck and the papers were taken into possession and on verification, the papers were found to be forged. On 25.8.1994, the accused surrendered before the police. The disclosure statement made by the accused led to recovery of three driving licences, two learning driving licences, two plain learner driving licences bearing stamps and signatures of DTO, Bathinda, two plain copies of the registration certificates pertaining to Rajasthan, two plain copies of registration certificates of Delhi, two plain copies of driving licences, two plain forms of transport permits, two plain challan forms under Section 32- A, five route permits, fake rubber stamps, one stamp pad and one green pencil which were taken into police possession vide Ex. PW8/C.
