JUDGEMENT

(1.) This revision petition has been preferred by the petitioner against judgments passed by learned Courts below thereby acquitting respondents No.1 to 4 of the charge framed under Sections 406/498-A IPC arising out of FIR No.97/2002 registered under Sections 494/495/498-A506 IPC at Police Station Goindwal Sahib.

(2.) Brief facts of the present case are that complainant-petitioner got married to Amrik Singh on 22.8.1999 according to Sikh rites. At the time of the marriage, the in-laws of the complainant-petitioner represented to her parents that their son would take the complainant to Germany. After the marriage, the complainant-petitioner stayed at Malsiyan, District Jalandhar, at her in-laws' house whereas her husband was staying in Germany. At the time of the marriage parents of the petitioner gave sufficient dowry articles for her use. At the time of marriage along with other dowry articles, on demand of the accusedrespondents amount of Rs.3.00 lac was also given in order to purchase a car. However, soon after the marriage, her husband and other family members started harassing her for bringing insufficient dowry. During the stay of the husband of the petitioner in India for about one month, the accused harassed the petitioner a lot but she did not disclose it to anyone.

(3.) However, when the husband of the petitioner was to leave India, she was asked to bring Rs.3.00 lac from her parents. She disclosed this incident to her parents. Her parents assured parents that their sons are staying at Holland and on their return to India, they would fulfil the said demand and requested to rehabilitate the petitioner at their home but the accused did not agree to that and declared that if the money was not brought within one month then she would not be allowed to reside in the said house. On 17.11.2002, Amrik Singh, husband of the petitioner returned to India and he asked parents of the petitioner for fulfilment of the demand. Her husband and other accused gave her beating. Then brother of the petitioner gave Rs.6.00 lacs to the accused after withdrawing the same from bank. After one month, her husband again went to Germany and later on, complainant came to know that her husband had already contracted a marriage with a woman namely Fitra Asman and from the said marriage, there was a child also. Thereafter, she came to her parental house at Fatehabad. Then, Panchayat was convened and accused were asked to rehabilitate the complainantpetitioner but they refused. The accused were also requested to deliver back the dowry articles but they refused to return the dowry articles. On the basis of the application of the complainant-petitioner, formal FIR was registered at Police Station. On completion of investigation, challan against the accused was presented in the Court.
