VACHITAR SINGH Vs. STATE OF HARYANA

JUDGEMENT

(1.) LEARNED State counsel has filed affidavit of Shri Devi Dayal, Deputy Superintendent, District Jail, Kurukshetra mentioning the period of imprisonment undergone by the applicant/appellant No.2- Balwinder Singh @ Goma. The same is taken on record.

(2.) HEARD learned counsel for the parties.

(3.) IN the incident that occurred on 02.10.2006, it has been alleged by Ranjit Singh @ Jeeta complainant that applicant/appellant No.2-Balwinder Singh @ Goma was armed with a hockey stick while Malak Singh (appellant No.4), Niranjan Singh (appellant No.3) and Vachitar Singh (appellant No.1) were armed with dandas. They had come and started abusing the complainant and raised a grievance as to why they had quarrelled in the bus. Kuljinder Singh @ Chhinda (deceased) questioned as to why were they abusing. Balwinder Singh @ Goma (applicant/appellant No.2) inflicted a hockey stick blow on the left side of the head of Kuljinder Singh @ Chhinda (deceased).
