JUDGEMENT

(1.) Appellant has preferred this appeal challenging his conviction and sentence for commission of offence punishable under Section 7 read with Section 13 (2) of the Prevention of Corruption Act, 1988 (for short 'the Act') as ordered by the Special Judge vide judgment/ order dated 9.8.2003 in FIR No.155 dated 26.11.1993 registered at Police Station Kotwali Bathinda.

(2.) Prosecution story, in brief, is that complainant Paramjit Singh was running a books and stationary shop at Rampura with Jagdish Kumar as a partner. On 31.12.1992, the said partners had settled their accounts. Complainant had, thereafter, started his own business in the name of Gill Book Centre, Rampura. Complainant had applied to the Punjab State Education Board (the Board for short) for licence/ agency card to him to sell the text books. In this regard, complainant had submitted application form along with requisite fee. Complainant met the appellant on 18.11.1993 with regard to his application but the appellant demanded Rs. 2,000/- for doing the needful. Ultimately, the deal was settled at Rs. 1,000/-.

(3.) Thereafter, complainant met the vigilance department on 26.11.1993 along with Som Dutt. Inspector Vigilance Burearu gave the demonstration of the working of the Phenol Phthalein Powder (PPowder for short) to the complainant and the shadow witness.
