(1.) CONVICTS Balbir Singh and his son Gurjinder Singh have filed this criminal revision petition assailing their conviction and sentence ordered by the courts below.
(2.) PETITIONERS stand convicted under sections 323 and 506 IPC and have been sentenced to undergo rigorous imprisonment for six months each for each of the two offences. Both the sentences have been ordered to run concurrently.
(3.) I have carefully considered the matter. The offence under section 506 IPC is not compoundable. Consequently, after conviction, on the basis of compromise, conviction cannot be quashed in the case of non- compoundable offence. However, benefit of compromise can be extended in the matter of quantum of sentence. Respondent no. 2 suffered simple injuries only in the occurrence. Parties belong to the same village. They are said to be inter-related also. Better sense has prevailed on the parties. They have arrived at the compromise with the intervention of relatives and respectables. The petitioners are in custody since 25.4.2013, the date of judgment of appellate court i.e. for more than one month.
