JUDGEMENT

(1.) Accused Jagsir Singh @ Jagga has challenged the conviction and sentence passed by the trial court under Section 302 IPC.

(2.) The case of the prosecution had been projected by the prosecution through the dying declaration of Baljeet Kaur which reads as under:-

(3.) The aforesaid statement of Baljeet Kaur was recorded by S.I. Surjit Singh who was examined as PW7 after obtaining the opinion as to the fitness of Baljeet Kaur to suffer a statement from PW4 Dr. Deepak Baghley. PW3 Dr. G.S. Mohi was present throughout the proceedings of dying declaration recorded by PW7. Baljeet Kaur died on 22.4.2009 at about 6.40 A.M. in the hospital.
