JUDGEMENT

(1.) This is an appeal directed by the State of Punjab against the judgment dated 22.3.2002 passed by Sh. Dhian Singh, Additional Sessions Judge (Adhoc), Fast Track Court, Amritsar, vide the accused respondent Manjit Kaur was acquitted of the charge against her.

(2.) The case of the prosecution as enumerated from the record is that the law was set in motion by recording the statement of Darbara Singh on 1.9.1998, who had stated that his son Harjinder Singh was married with Manjit Kaur, accused d/o Didar Singh about 4 1/2 years before the occurrence. They were blessed with two sons. 4-5 months before the occurrence relations between Harjinder Singh and Manjit Kaur became strained as character of Manjit Kaur was not right. Harjinder Singh used to object the accused from her objectionable activities pertaining to her character but she remained adamant. As such the accused left matrimonial house of Harjinder Singh and went to the house of her parents. Complainant and Harjinder Singh tried to persuade her so many times, that their honour and respect are involved, therefore, she should not indulge in her objectionable activities pertaining to her character. They also requested her to come back and live with Harjinder Singh, but to no effect. Harjinder Singh became somewhat disgusted and mentally upset. He committed suicide on the intervening night of 31.8.1998 and 1.9.1998 by hanging with a towel (purna) tied by him with the grill of ventilator of the house. Complainant came to know this at about 3.00 A.M. when he was going to urinate. The complainant blamed the accused outrightly for the suicide committed by his son. On the statement made by the complainant formal FIR was recorded. Dead body was sent for post mortem examination. Accused was arrested and after completion of the investigation challan was presented against her.

(3.) Copies of documents were supplied to the accused. The case was committed to the Court of Sessions.
