SAHAB SINGH Vs. STATE OF HARYANA

JUDGEMENT

(1.) PETITIONER -Sahab Singh son of Shamsher Singh @ Sher Singh, has directed the instant petition for the grant of regular bail in a case registered against him along with his other co-accused, namely, R.K.Nanda, Sanjay Tyagi and Ashok Kumar etc., vide FIR No.455 dated 03.12.2010, for the commission of offences punishable under Sections 420, 467, 468, 471, 379 and 506 IPC, by the police of Police Station Sarai Khawaja, District Faridabad, invoking the provisions of Section 439 Cr.P.C.

(2.) NOTICE of the petition was issued to the State.

(3.) COMPLAINANT -Sanjeev Uppal, authorized signatory of M/s CE Construction Limited, has claimed that the petitioner and his other co- accused have removed the pointed machinery and other articles, in order to dispossess the company from the plot, in question, at the instance of main accused R.K.Nanda and Sanjay Tyagi. It is not a matter of dispute that during the course of investigation, main accused R.K.Nanda and Sanjay Tyagi were found innocent and were exonerated by the police. Otherwise, very vague and general allegations are assigned to the petitioner in this respect.
