PRITAM SINGH Vs. STATE OF PUNJAB

JUDGEMENT

(1.) THIS petition seeks the concession of anticipatory bail to the three petitioners, i.e. Pritam Singh son of Gudder Singh, Mall Singh and Iqbal Singh, both sons of Bagha Singh.

(2.) PETITIONER No.1 is stated to be not named in the FIR, in which petitioners No.2 and 3, along with 14 others, have been named amongst those who attacked the complainant party and caused injuries to the complainant, Surjit Singh, his father, Mahinder Singh, his uncle Joginder Singh and his cousin, Mukhtiar Singh. The accused, including petitioners No.1 and 3, are also stated to have received multiple injuries in the fight which took place, as is shown in the medico legal reports, annexed as Annexures P -2 and P -3, respectively. Petitioner No.1 is stated to have received a lacerated wound on his head and about 8 small and other injuries all over the rest of the body. Petitioner No.3 is also stated to have received two injuries, one lacerated wound and one contour.

(3.) THE cause of the fight was the allegation that the above mentioned Ashok Kumar, son of deceased Mukhtiar Singh, was, allegedly, sexually exploiting Jyoti for many months and, on the date of the occurrence, is alleged to have come with two accomplices to the courtyard of her house and first molested her and then, allegedly, raped her.
