JUDGEMENT

(1.) Petitioner-Gurpeet Singh, main accused(husband) has preferred the instant petition for the grant of anticipatory bail in a case registered against him along with his other co-accused, Jagjit Singh (father), Gurdeep Kaur(mother) and others, by means of FIR No.45 dated 15.04.2012, for the commission of offences punishable under Sections 498-A, 406 and 120-B IPC, by the police of Police Station Lambi, District Sri Muktsar Sahib, invoking the provisions of Section 438 Cr.P.C.

Concisely, the prosecution claimed that, the marriage of Gagandeep Kaur, daughter of the complainant-Swaran Singh (for brevity "the complainant") was solemnized with petitioner-Gurpreet Singh on 26.06.2011, according to Hindu rites and ceremonies in Golden Palace at Mandi Kilian Wali, District Sri Muktsar Sahib. The complainant was stated to have spent the huge amount at the time of marriage of his daughter beyond his capacity and gave furniture, almirah, fridge, TV, cooler, Rs.2,20,000/- cash, utensils of Rs.30,000/-, clothes of Rs.40,000/-, three tolas of gold valuing Rs.76,000/- and other customary dowry articles in the presence of Jagsir Singh son of Mukand Singh, Gurjant Singh son of Jugraj Singh and Surjit Singh son of Bachhitar Singh. The petitioner also took Rs.10,000/- for the installation of inverter from him.

(3.) The complainant claimed that after some time of the marriage, the petitioner and his other co-accused started harassing his daughter and demanded more dowry articles. Moreover, they have turned her out of matrimonial home after removing her golden ear-rings, necklace, bangles and rings etc. The petitioner and his other co-accused were stated to have threatened the complainant that, in case, he wanted to get his daughter settled in the matrimonial home, then he has to give more dowry articles, including dressing table, TV stand, washing machine, bedding of Rs.50,000/-, golden chain of 10 gms for the boy, eight golden rings for the boy and his father, bangles for the mother and sister and cash etc.
