JUDGEMENT

(1.) The crux of the facts and material, which needs a necessary mention, for the limited purpose of deciding the instant petition for anticipatory bail, filed by Amarjit Kaur wife of Tarsem Singh and emanating from the record, is that complainant Naazar Singh is an old person of more than 100 years. He is the owner in possession of the house in question. The petitioner and her husband (co-accused) are his close relatives. They approached to help him on the pretext of installation of the electricity connection in his (complainant) house. They took him to some government officers at Nakodar & then Jalandhar and obtained his thumb impression on some blank papers in the garb of electricity forms.

Leveling a variety of allegations and narrating the sequence of events in detail, in all, the complainant claimed that the petitioner and her other co-accused obtained his thumb impression on blank papers, used and converted the same as sale documents of his house, in their favour, in order to cause wrongful loss to him and wrongful gains for themselves. In this manner, the accused have attempted to commit the criminal house trespass, caused damage and cheated the complainant. In the background of these allegations and in the wake of complaint of the complainant, the present case was registered against the accused, by virtue of FIR No.6 dated 11.01.2013, on accusation of having committed the offences punishable under Sections 447, 448, 511, 427, 380 & 420 IPC, by the police of Police Station Nakodar, District Jalandhar, in the manner depicted here-in-above.

(3.) Having exercised her right and remained unsuccessful in the court of Additional Sessions Judge, now the petitioner has preferred the present petition in this Court for the grant of anticipatory bail in the indicated case, invoking the provisions of Section 438 Cr.P.C.
