JUDGEMENT

(1.) Appellant faced trial qua commission of offence punishable under Sections 7, 13(2) of the Prevention of Corruption Act, 1988 (for short 'the Act') in FIR No.20 dated 20.4.1999 registered at Police Station Vigilance Bureau, Jalandhar.

(2.) Prosecution story,in brief, is that complainant-Chanan Singh had installed electric motor in his residence which was situated in the fields. One electric pole got damaged and, consequently, their electric supply was disconnected. Complainant approached the appellant to reinstall the pole. However, appellant raised a demand of Rs. 1500/- for doing the needful. It was settled at Rs. 1000/-.

(3.) Complainant assured the appellant that he would pay Rs. 1000/-, initially, and would pay Rs. 500/- at a later stage. Complainant approached the Vigilance Department. Deputy Superintendent of Police (for short 'DSP')-Pinder Singh recorded the statement of the complainant and, on the basis of the same, formal FIR was registered. Complainant handed over ten currency notes in the denomination of Rs. 100/- each to the DSP, who returned the same to the complainant after application of phenolphthalein powder (hereinafter referred to as P.Powder). Complainant was directed to hand over the said currency notes to the appellant on demand.
