JUDGEMENT

(1.) Petitioner-lady being Sarpanch had lodged an FIR under Section 379 IPC on 26.1.2010 against the respondent alleging that the respondent and others had cut Bud threes standing in the Gram Panchayat street. Half of the trees had already been sold, whereas remaining half were being taken for sale. The aim was that the respondent and others wanted to take possession of the street illegally. Soon after lodging of the complaint, the parties entered into a compromise on 29.1.2010 as respectables of the village intervened. For resolving the matter, four arbitrators were appointed, who were respectables of the village. Accordingly, a decision was taken to donate these trees to Mandir in the village. Both the parties consented for the same. Police accordingly filed a cancellation report in this FIR and the same was cancelled.

(2.) It is noticed that an earlier complaint was also filed by some villagers, which had ended in a compromise. The parties had agreed to vacate the land and the street was to be treated as a Shamlat street over which none was to raise construction.

After having entered into a compromise, the respondent herein has decided to file the present complaint under Sections 465, 467, 468, 471, 499 and 500 IPC before the Court of Judicial Magistrate Ist Class, Kurukshetra. As per the respondent, he is a reputed person and the petitioner had lodged a false FIR of theft against him, thus, showing the respondent-complainant as a thief.
