JUDGEMENT

(1.) Accused Joginder Singh was convicted for an offence under Sections 302, 201 and 404 of the Indian Penal Code. He was sentenced to undergo imprisonment for life and to pay a fine of Rs.10,000/- and in default of payment of fine to further undergo RI for a period of one year. He was sentenced to undergo RI for three years and to pay a fine of Rs.5000/- and in default of payment of fine to further undergo RI for a period of six months under Section 201 IPC. He was also sentenced to undergo RI for one year and to pay a fine of Rs.1000/- and in default of payment of fine to further undergo RI for a period of three months under Section 404 IPC. He has challenged the judgment of conviction and sentence rendered by the trial Court.

(2.) It is the case of the prosecution that Risal Singh, Sarpanch of village Barana gave statement Exhibit PK to ASI Jodha Ram (PW-12) alleging that the dead-body of a person was found near G.T. Road. PW-12 proceeded along with Risal Singh Sarpanch to the site of occurrence. Inquest was conducted on the dead body and inquest report Exhibit PM was prepared. He took steps for identification of the dead body. Snaps of the dead body were taken by the photographer. Clothes of the dead body were also searched. A boarding pass was taken into possession vide memo. Exhibit PO. Rough site plan Exhibit PP reflecting the scene of occurrence was prepared by PW-12.

(3.) On 24.1.2004, PW-7 Gurdeep Kaur, sister of the deceased Inderjit Singh and PW-10 Hari Singh, husband of Gurdeep Kaur, proceeded to the Government Hospital, Karnal and identified the dead-body. PW-7 made statement Exhibit PA before the police. In her statement, she submitted that on 24..1.2004, deceased Inderjit Singh who was settled in Sweden had come to India to attend a relative's marriage. On 23.1.2004 at about 9 PM, she received a telephonic message that the dead-body of Inderjit Singh Parmar was found at Barana link road near G.T. Road.
