JUDGEMENT

(1.) Vide this judgment, the above mentioned two appeals, would be disposed of as they have arisen out of judgment/order dated 05.03.2003 passed by the Special Judge.

(2.) Prosecution story, in brief, is that Hem Raj, complainant was working as a Contractor with the Food Corporation of India ('FCI' for short). Complainant had been given the contract for stitching bags for the FCI. Complainant had submitted the relevant papers for his final payment in the Accounts Branch of the FCI to the tune of Rs. 21,530/-. However, Vinod Kumar, appellant raised a demand of Rs. 500/- from the complainant on 25.7.2000. The deal was settled at Rs. 400/-. It was agreed that the cheque would be paid to the complainant on 26.07.2000, after receipt of the bribe money. Complainant approached the Vigilance Department along with Raj Kumar. Statement of the complainant was recorded by the Deputy Superintendent of Police, Vigilance Bureau ('DSP' for short).

(3.) Complainant handed over four currency notes in the denomination of Rs. 100/- each to the DSP, who in turn, returned the same to the complainant after application of Phenolphthalein Powder.
